Please read these terms carefully before using the 1Stop Driving School platform. By accessing or using our website, you agree to be bound by these terms.
1. Agreement to Terms
These Terms of Service (“Terms”) govern your use of the website www.1stopdrivingschool.com.au (“Website”) and the services provided by 1Stop Driving School (“we”, “us”, “our”). By accessing or using our Website, you agree to be bound by these Terms. If you do not agree, you must not use the Website.
We may update these Terms from time to time. The most current version will always be available on this page. Continued use of the Website after changes are posted constitutes acceptance of the revised Terms.
2. Service Description
1Stop Driving School operates an online marketplace that connects learner drivers (“Learners”) with independent, verified driving instructors (“Instructors”).
1Stop Driving School is a marketplace platform, not a driving school. We do not employ, engage, or supervise Instructors. We do not provide driving lessons, and we do not control how Instructors conduct their business, set their prices, or deliver their services. All driving lessons are arranged directly between Learners and Instructors.
Our platform allows Learners to:
- Search for driving instructors by suburb, price, vehicle type, and language
- View instructor profiles, qualifications, and reviews
- Submit a lead request to contact an instructor directly
Our platform allows Instructors to:
- Create and manage a public profile listing their services
- Set their own pricing and service areas
- Receive lead requests from interested learners
3. User Eligibility
To use our services, you must:
- Be an Australian resident or be physically located in Australia
- Be at least 16 years of age (or the minimum age to hold a learner permit in your state or territory)
- If you are a Learner seeking driving lessons, you must hold a valid learner permit issued by the relevant state or territory transport authority
- Provide accurate and truthful information when using our forms or creating an account
If you are under 18, you represent that you have the consent of a parent or legal guardian to use this Website and its services.
4. Pricing and Fees
4.1 Free for Learners
The 1Stop Driving School platform is completely free for Learners. There is no charge to search for instructors, view profiles, read reviews, or submit lead requests.
4.2 Instructor Lead Fees
Instructors are charged a fee of $25 (AUD) per lead received through the platform. A “lead” is defined as a completed lead request form submitted by a Learner for that Instructor. Lead fees are non-refundable except in cases of duplicate leads, spam, or fraudulent submissions, which will be reviewed on a case-by-case basis.
4.3 No Commission
We do not charge any commission on driving lesson fees. Instructors retain 100% of the fees they charge their students for lessons. The lead fee is the only charge Instructors pay to 1Stop Driving School.
4.4 Changes to Fees
We reserve the right to change our fee structure with reasonable notice to Instructors. Any fee changes will be communicated at least 30 days in advance via email and will not apply retroactively to leads already received.
5. Learner Responsibilities
As a Learner using our platform, you agree to:
- Provide accurate and complete information in all forms and communications
- Hold a valid learner permit before booking any driving lessons
- Communicate respectfully with Instructors and other users
- Not submit fake, spam, or malicious lead requests
- Not use the platform for any purpose other than finding a driving instructor for legitimate driving lessons
- Understand that all lesson arrangements, including pricing, scheduling, and cancellation terms, are solely between you and the Instructor
6. Instructor Responsibilities
As an Instructor listed on our platform, you agree to:
- Hold a current and valid driving instructor licence issued by the relevant state or territory transport authority
- Maintain current comprehensive vehicle insurance for the vehicle used for lessons
- Hold a valid Working With Children Check (WWCC) or equivalent in your state or territory, where required
- Provide accurate, truthful, and up-to-date information on your profile, including pricing, service areas, qualifications, and vehicle details
- Respond to lead requests in a timely and professional manner
- Use Learner personal information received through lead requests solely for the purpose of responding to that enquiry and providing driving lessons
- Comply with all applicable Australian laws, regulations, and industry standards
- Notify us promptly if your instructor licence, insurance, or WWCC expires, is suspended, or is revoked
- Not engage in any conduct that may harm the reputation of 1Stop Driving School or the safety of Learners
We reserve the right to suspend or remove any Instructor profile that fails to meet these requirements or breaches these Terms.
7. Verification and Quality
We undertake reasonable steps to verify Instructor credentials at the time of registration and on an annual basis, including driving instructor licence, insurance, and Working With Children Check. However:
- We do not guarantee the accuracy, completeness, or currency of any information provided by Instructors
- Verification is conducted to the best of our ability but does not constitute an endorsement, warranty, or guarantee of any Instructor's competence, quality of service, or suitability
- Learners are responsible for conducting their own due diligence before engaging an Instructor
8. Limitation of Liability
To the maximum extent permitted by law:
- No liability for instructor conduct: 1Stop Driving School is not liable for the acts, omissions, conduct, or negligence of any Instructor. Instructors are independent operators and are not employees, contractors, or agents of 1Stop Driving School.
- No liability for lesson outcomes: We do not guarantee that any Learner will pass their driving test or achieve any particular outcome from lessons arranged through our platform.
- No liability for third-party disputes: Any disputes regarding lesson quality, pricing, scheduling, cancellations, refunds, or other matters are between the Learner and the Instructor. We are not a party to any agreement between Learners and Instructors.
- Service availability: We do not guarantee that the Website will be available at all times, error-free, or free of viruses or other harmful components.
- Indirect loss: To the maximum extent permitted by the Australian Consumer Law and other applicable legislation, we exclude liability for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Website or services.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
9. Indemnification
You agree to indemnify, defend, and hold harmless 1Stop Driving School, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Website or services
- Your breach of these Terms
- Your violation of any applicable law or the rights of any third party
- Any content or information you submit through the platform
10. Intellectual Property
All content on the Website, including but not limited to text, graphics, logos, icons, images, software, and the compilation thereof, is the property of 1Stop Driving School or its content suppliers and is protected by Australian and international copyright, trademark, and other intellectual property laws.
You may not:
- Reproduce, modify, distribute, or publicly display any content from the Website without our prior written consent
- Use any data mining, robots, scraping, or similar data-gathering tools on the Website
- Use the 1Stop Driving School name, logo, or branding in any way that suggests endorsement or affiliation without our written permission
Instructors retain ownership of the content they submit to their profiles (such as biography text and profile descriptions). By submitting content, Instructors grant us a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content on the Website for the purpose of operating the platform.
11. User Content and Reviews
Users may submit reviews, ratings, and other content to the platform. By submitting content, you represent that:
- The content is accurate and based on your genuine experience
- The content does not contain defamatory, abusive, or unlawful material
- You have the right to submit the content and it does not infringe any third-party rights
We reserve the right to remove, edit, or refuse to publish any user content that we determine, at our sole discretion, violates these Terms or is otherwise objectionable. We do not verify the accuracy of user reviews and are not liable for any content submitted by users.
12. Dispute Resolution
If you have a dispute with another user (whether Learner or Instructor), you agree to first attempt to resolve the dispute directly with the other party. 1Stop Driving School is not obligated to mediate or resolve disputes between users, but we may choose to assist at our discretion.
If you have a dispute with 1Stop Driving School directly, we agree to the following process:
- Informal resolution: Contact us at hello@1stopdrivingschool.com.au and we will endeavour to resolve the matter within 14 business days.
- Mediation: If informal resolution fails, either party may refer the dispute to mediation administered by the Australian Disputes Centre (ADC) or an equivalent mediation service in New South Wales.
- Legal proceedings: If mediation fails, either party may commence legal proceedings in the courts of New South Wales, Australia.
13. Termination of Accounts
We reserve the right to suspend or terminate any user account, or restrict access to the Website, at any time and for any reason, including but not limited to:
- Breach of these Terms
- Provision of false or misleading information
- Fraudulent, abusive, or harmful conduct
- Failure to maintain required credentials (for Instructors)
- Non-payment of lead fees (for Instructors)
- At the request of law enforcement or government authorities
Instructors may close their account at any time by contacting us at hello@1stopdrivingschool.com.au. Upon account closure, any outstanding lead fees remain payable. We will remove the Instructor's public profile within 5 business days of receiving the closure request.
14. Prohibited Conduct
You must not use the Website to:
- Violate any applicable law or regulation
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Transmit spam, unsolicited communications, or any content that is harmful, offensive, or objectionable
- Attempt to gain unauthorised access to the Website, other accounts, or any systems or networks connected to the Website
- Interfere with or disrupt the operation of the Website or servers or networks connected to it
- Scrape, harvest, or collect personal information of other users without their consent
- Use the platform to advertise or promote services unrelated to driving instruction
15. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from those courts.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed from these Terms and the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and 1Stop Driving School regarding your use of the Website and services. They supersede all prior agreements, representations, and understandings, whether written or oral.
